中咨工程建设监理公司（以下称采购代理机构）受中国国际贸易促进委员会（以下称采购人）的委托，以公开招标方式选择中国国际贸易促进委员会经贸摩擦应对法律服务供应商库邀请符合资格条件的律师事务所、研究机构、高等院校以及其它专业服务机构（以下称投标人）参加投标。
CIECC Engineering Construion Proje Management Corporation (hereinafter referred to as the “Procurement Agency”), entrusted by China Council for the Promotion of International Trade (hereinafter referred to as the “Purchaser”), now invites eligible and qualified law firms, research institutions, institutions of higher learning and other professional service organizations (hereinafter referred to as “the Bidder”) to submit sealed bids for selection of the entry of law firms, research institutions, institutions of higher learning and other professional service organizations into China Council for the Promotion of International Trade's candidate list of Law Firms in Response to Economic and Trade Friions.

投标人应当具备下列条件：
The Bidder shall meet the following conditions:

（1）投标人应为合法注册的相关专业服务机构,包括律师事务所、研究机构、高等院校以及其它专业服务机构。
（1）Bidders shall be legally registered relevant professional service institutions, including law firms, research institutions, institutions of higher learning and other professional service organizations.

①境内律师事务所投标人指在中国大陆注册的律师事务所；
① Chinese law firm Bidders shall be registered in the mainland of China;

②境外律师事务所投标人指港澳台地区及境外注册的律师事务所，且须在境内设立的办事处或代表处；
② Foreign law firm Bidders shall be registered in Hong Kong SAR, Macao SAR and Taiwan Province as well as foreign countries with offices or representative offices in China;

（2）具有独立承担民事责任的能力；
（2） HA/Ving the ability to independently bear civil liabilities;

（3）具有良好的商业信誉和健全的财务会计制度；
（3）HA/Ving good business reputation and sound financial and accounting system;

（4）具有承办委托法律服务事项的团队和能力；
（4） HA/Ving a team with the ability to undertake the entrusted legal services;

（5）境内律师事务所及境外律师事务所在境内设立的办事处或代表处、研究机构、高等院校以及其它专业服务机构有依法缴纳税收和社会保障资金的良好记录；
（5） Good records about the payment according to law for taxes and social security funds provided by offices or representative offices, research institutions, institutions of higher learning and other professional service institutions set up by domestic and foreign law firms in China;

（6）参加政府采购活动前三年内，在经营活动中没有重大违法记录；
（6） No significant illegal records in the operation within 3 years since joining the governmental purchasing aivities;

（7）境内律师事务所及境外律师事务所在境内设立的办事处或代表处、研究机构、高等院校以及其它专业服务机构符合《财政部关于在政府采购活动中查询及使用信用记录有关问题的通知》（财库〔2016〕125号）的相关要求；
（7）Offices or representative offices, research institutions, institutions of higher learning and other professional service organizations set up by domestic and foreign law firms conform to Notification of Ministry of Finance on Issues Related to Credit Record Inquiry and Use in Governmental Purchasing Aivities (CK [2016] No. 125);

（8）本项目不接受联合体；
（8）Consortium is not accepted in this proje;

（9）投标人必须到采购代理机构购买招标文件（即“采购文件”，下同）并登记备案。未经向采购代理机构购买招标文件并登记备案的投标人将被拒绝；

八、采购项目需要落实的政府采购政策：

中小微型企业有关政策

Relevant policies of small and medium-sized enterprises

根据工信部等部委发布的《关于印发中小企业划型标准规定的通知》（工信部联企业〔2011〕300号），根据具体品目确定相应标准。符合上述条件的中小微型企业应按照招标文件的格式要求提供《中小企业声明函》。
According to the notice issued by the Ministry of Industry and Information Technology and other ministries and commissions on the standard requirements for the issuance of small and medium-sized enterprises (the Ministry of Industry and Information Technology [2011] 300), the corresponding standards shall be determined according to the specific items. Medium small and micro-sized enterprises that meet the above conditions shall provide the Enterprise Declaration Letter of small and medium-sized Enterprises in accordance with the format of the bidding document.

根据财政部发布的《政府采购促进中小企业发展暂行办法》规定，对于非专门面向此类企业的项目，对小型和微型企业产品的价格给予6%的扣除，用扣除后的价格参与评审。
According to the Notice of the Ministry of Finance on Issuing the Interim Measures for Promoting the Development of Small and Medium-sized Enterprises through Government Procurement, for the projes that are not specifically for such enterprises, give 6% deduion for the produ price of small and micro-sized enterprise, and use the price after deduion to participate in the review.

节能环保要求

Energy sA/Ving and environmental proteion requirements

投标人提供产品如是环境标志产品，应列入财政部、环保部联合印发的《关于调整环境标志产品政府采购清单的通知》中公布的清单。注：施行优先采购的产品按照优先采购执行。如是节能产品，应列入《财政部、国家发展改革委关于调整节能产品政府采购清单的通知》中公布的清单。注：施行强制采购的产品按照强制采购执行。（需提供该产品所在的环保或节能产品政府采购清单页）
Such environmental labeling produs provided by the bidder shall be included in the list published on the Notice of the Government Procurement List of the Adjustment of the Environmental Labeling Produs issued by the Ministry of Finance and the Ministry of Environmental Proteion. Note: the produs carried out by preferential procurement shall be performed according to preferential procurement.
