投标申请人声明

致招标人

本公司就参加投标工作，作出郑重声明：

一、本公司保证投标报名材料及其后提供的一切材料都是真实的，且不存在招标公告2.8款规定的情形。

二、本公司保证在本项目投标中不与其他单位围标、串标，不出让投标资格，不向招标人或资格审查委员会成员行贿。我公司承诺不弄虚作假，骗取中标，原则愿意接受公开通报，承担由此带来的责任和法律后果，包括但不限于取消投标或中标资格（如果已取得中标）、接受行政监督部门的行政处罚，自愿放弃参加市水务集团公司所辖范围内三年的招标投标活动，并同意招标人将其弄虚作假行为上报行政监督部门进行严肃查处。

三、本公司没有处于被责令停业的状态；没有处于被行政主管部门取消投标资格的处罚期内；没有处于财产被接管、冻结、破产的状态；在投标报名截止日期前三年内没有行政主管部门已书面认定的重大工程质量问题；在广州市人民检察-院行贿犯罪档案查询结果中，本公司没有在投标报名截止时间前两年内被人民法院判决犯有行贿罪的记录。

四、严格遵守建设工程余泥渣土运输与排放管理制度，执行“一不准进、三不准出”规定。承诺如违反建设工程余泥渣土运输与排放管理制度，将自愿接受：通报批评，记录不良行为，列入黑名单，并暂停责任企业投标报名一年，对责任项目负责人暂停投标报名二年。多次违规的，暂停投标报名二至三年，并提请资质审批部门降低或吊销企业资质、项目经理的建造师从业资格和专职安全员安全培训考核证书。

五、本公司及其有隶属关系的机构没有参加本项目的招标文件编写、监理工作；本公司与承担本监理业务的单位没有隶属关系或其他利害关系。

六、本公司没有在公布处罚期内的违法行为。

七、本公司拟任本项目项目经理的建造师在本次投标期间未在其他项目中担任项目经理。

八、本公司的本次投标行为不存在违反法律法规强制性规定的其他情形。

本公司违反上述保证，或本声明陈述与事实不符，经查实，本公司愿意接受被取消中标资格、公开通报，承担由此带来的法律后果，并自愿停止参加你单位的招标投标活动一年。

联合体投标协议书

（1）联合体由牵头方负责与招标人联系。

（3）联合体将严格按照招标文件的各项要求，递交投标文件，切实执行一切合同文件，共同承担合同规定的一切义务和责任，同时按照内部职责的划分，承担自身所负的责任和风险，在法律方面承担连带责任。

（4）如中标，联合体内部将遵守以下规定：

a．联合体牵头方和成员共同与招标人签订合同书，并就中标项目向招标人负有连带的和各自的法律责任；

b．联合体牵头方代表联合体成员承担责任和接受招标人的指令、指示和通知，并且在整个合同实施过程中的全部事宜（包括工程价款支付）均由联合体牵头方负责；

（5）投标工作和联合体在中标后工程实施过程中的有关费用按各自承担的工作量分摊。

3．本协议书自签署之日起生效，在上述（4）a所述的合同书规定的期限之后自行失效；如中标后，联合体内部另有协议的，联合体牵头方应将该协议书送交招标人。

4．本协议书正本一式份，联合体成员各份。
